Commission proposes regulation on EPREL operational details (GEN – 1465.00)

GEN -1465.00. At the Ecodesign and Energy Labelling Consultation Forum meeting of 28 February 2023, the European Commission presented its working document for a new Implementing Regulation laying down operational details for EPREL. 

Implementing Regulation laying down operational details for EPREL

The European Commission organised a meeting of the Ecodesign and Energy Labelling Consultation Forum on 28 February 2023. The meeting was dedicated to the Commission’s proposal for a new Implementing Regulation laying down operational details for EPREL. A written feedback window is open for 4 weeks.

The legal basis for the new Implementing Regulation is article 2, point 12 of the framework Energy Labelling Regulation (EU) 2017/1369. This point empowers the Commission to specify by means of implementing acts of the operational details of EPREL. The idea is to set into law what is already mostly practiced today by suppliers subject to the EPREL registration obligation, and to fill in some of the remaining legal gaps.

Chapter II of the proposal deals with the verification process for suppliers and sets out the requirements associated with the qualified electronic seal that is needed.

Chapter III of the proposal deals with other operation issues, including access rights, user profiles, information requirements, the data exchange model, maintenance, and availability of the EPREL database, and unlawful use.

Recommended actions

Manufacturers subject to EPREL registration obligations are recommended to read the Commission working document and the accompanying explanatory note. It is possible to submit written feedback to the European Commission for a 4-week period. The Commission is open to receive detailed comments on specific provisions, but also high-level perspectives on legal gaps that still need to be covered that were not included in the working document. Manufacturers that have relevant feedback for the Commission are strongly encouraged to share it with the Eurovent Secretariat as well.
