State of play

On 05 April 2022, the European Commission published a legislative proposal that would repeal and replace the 2009 Regulation on Ozone-depleting substances (ODS). The Parliament adopted its negotiating position on 07 March 2023; the Council on 05 April 2023.

A provisional agreement was reached on 05 October 2023. The agreement introduces no notable changes relevant for the HVACR sector. It maintains the general prohibition on ODS and the applicable exemptions such as for feedstocks.

Final adoption by Parliament and Council and subsequent publication are expected in Q1 2024.

The database contains the most recent publications but also allows you to go back in time.It sets out strict rules on the production, import, export, use, labelling, and reporting of ozone-depleting substances (ODS) and products containing them. The legislation introduces bans with limited exemptions for essential uses such as feedstocks, laboratory applications, and certain critical halon uses. In addition, it requires recovery and safe handling of ODS during servicing and dismantling of equipment and introduces obligations for leak checks and emission minimisation. The regulation also establishes an electronic licensing system to control trade and imposes strict documentation, labelling, and reporting requirements on companies.
